Letter to Commissioner WIlson:

This email is to advise that our STOP KIMCO - SAVE DP FB page has gone public with the information on the request for approval to rezone the parcel from C-1 to a PD, along with the requested waivers that are included in LUP-23-05-144 (Dr Phillips Commercial LUP).
The Application is a fabrication of issues that do not exist, that are supported by nebulous justifications that cannot be supported by facts.
While we have no problem with good, managed growth, this particular project if approved will forever change the character of the heart of Dr. Phillips. We understand that all property owners have the rights to request these modifications to the entitlements on their property, and the process has to play out, but the entitlements that this property owner has enjoyed for the past 20 years have not changed. This is development for the sake of investment return, disregarding the character and needs of one of Orange County's oldest and established communities.
Also, approval of this application to proceed may create a precedent for KIMCO to lean on when it comes time for them to apply for the necessary revisions to initiate their project. (Note that we are scheduled to meet with Josh Gelfman from KIMCO on 5/22/23)

If this doesn’t sound familiar you haven’t been following our fight close enough. the The names and identities has not been changed or even hidden. So now it is in the open. No attempt to hide the fact that this is definitely Kimco’s intent and long term purpose. We will stay the course. It may live out a couple of the chair persons. November Update
Sorry for the delay is issuing this update. Orange County has confirmed this morning that another month has passed without any application being submitted for review for the proposed MF project at the Marketplace!
We have had a couple of telephone conversations with Kimco's SE VP of Development. They want to have a dialogue with the Steering Committee to 'fully understand' our position against the proposed apartments.
We are waiting for them to propose dates where the members of the Steering Committee and Kimco are mutually convenient.
One good thing that comes out of the current economic conditions is that the interest rates may be affecting Kimco's near term decision process to our benefit. There is much data coming available, within the development community that shows that projects anticipated to be built in the 2023-2024 time frame are now marginally viable at today's interest rates - thus delaying or cancelling many projects that appeared earlier this year to be slam dunk successes.
Finally, another nugget that we have gleaned comes from Hurricane Ian and Hurricane Nicole. Both storms resulted in significant flooding of the stormwater system on Sandlake Road in front of the Marketplace. Orange County had crews out on SLR yesterday afternoon clearing drains.
If anyone has any pictures of the repair crews, please post them, as this would help our argument that a MF project on the Marketplace property will further reduce the capabilities of the stormwater infrastructure.
